These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Guest”, or “Host”) and BOOKASTAYNAIJA LTD (“BookaStay Naija”, “we”, “us”, or “our”), governing your access to and use of the BookaStay Naija platform, including our website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Platform.

1. PLATFORM OVERVIEW

BookaStay Naija is an online marketplace that connects property owners, agents or managers (“Hosts”) with individuals seeking short-term accommodation (“Guests”).
We facilitate listings, bookings, and payments but do not own, control, manage, or operate any listed properties.

2. ELIGIBILITY

You must:

  • Be at least 18 years old;
  • Have the legal capacity to enter binding contracts;
  • Provide accurate and truthful information.

We reserve the right to refuse access or terminate accounts that do not meet these requirements.

3. ACCOUNT REGISTRATION & SECURITY

To use certain features, you must create an account.

You agree to:

  • Provide accurate, current, and complete information;
  • Maintain the confidentiality of your login credentials;
  • Accept responsibility for all activities under your account.

We are not liable for any loss resulting from unauthorized access to your account.

4. BOOKINGS & PAYMENTS

4.1 Booking Process

  • Guests can browse and book properties listed by Hosts.
  • A booking is confirmed only after full payment is successfully processed.

4.2 Payment Processing

  • All payments are processed via third-party providers (e.g., Paystack).
  • By making a booking, you authorize us to charge your selected payment method.

4.3 Payouts to Hosts

  • Hosts will receive payouts 24 hours after guest check-in, subject to no disputes.
  • Payments are made to the Host’s registered payout method.

5. PLATFORM FEES

  • BookaStay Naija charges a 10% service fee on each booking.
  • This fee is deducted from the Host’s payout.
  • Guests pay the full listing price as displayed on the Platform.

6. USER RESPONSIBILITIES

You agree not to:

  • Use the Platform for unlawful or fraudulent purposes;
  • Provide false or misleading information;
  • Circumvent the Platform to complete bookings outside the system;
  • Interfere with the proper functioning of the Platform.

7. COMMUNICATION POLICY

All communications between Guests and Hosts must occur through the Platform until a booking is confirmed.

Attempts to:

  • Share contact details prematurely;
  • Arrange off-platform bookings;

may result in suspension or permanent removal.

8. HOST OBLIGATIONS

Hosts must:

  • Ensure listings are accurate and up-to-date;
  • Maintain the property in a safe and habitable condition;
  • Honor confirmed bookings;
  • Provide valid verification documents when required.

Failure to comply may result in listing removal or account termination.

9. GUEST OBLIGATIONS

Guests must:

  • Use the property responsibly;
  • Follow house rules;
  • Report issues within the required timeframe;
  • Pay for any damages caused beyond the caution fee if applicable.

10. CANCELLATIONS & REFUNDS

All cancellations and refunds are governed by the Refund & Cancellation Policy, which forms part of these Terms.

11. DAMAGE & DISPUTES

Disputes between Guests and Hosts are governed by the Damage & Dispute Policy.
BookaStay Naija reserves the right to make the final decision in all disputes.

12. DISCLAIMER OF WARRANTIES

The Platform is provided on an “as is” and “as available” basis

We do not guarantee:

  • The accuracy of listings;
  • The condition or safety of properties;
  • Continuous or error-free operation of the Platform.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by Nigerian law:

BookaStay Naija shall not be liable for:

  • Indirect or consequential damages.
  • Loss of profits, data, or goodwill.
  • Issues arising from interactions between Users.

Our total liability shall not exceed the amount paid for the booking in question.


14. TERMINATION

We may suspend or terminate your account if you:

  • Violate these Terms;
  • Engage in fraudulent or abusive behavior;
  • Attempt to bypass Platform rules.

15. INTELLECTUAL PROPERTY

All content on the Platform (excluding user-generated content) is owned by BookaStay Naija and protected under applicable laws.

You may not copy, reproduce, or distribute any content without permission.

16. MODIFICATIONS

We may update these Terms at any time.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.

17. GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Nigeria.

Any disputes shall be resolved in the courts of Lagos State.
